Rules and conditions for using Arc en Ciel.

Introduction
Arc en Ciel provides an online platform at arcenciel.io and its subdomains for registered users to host and share AI or ML models, images, videos, articles, collections, metadata, and related creator workflows.
By accessing or using the platform you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the platform.

Eligibility and Accounts
- You must be 18 years or older.
- Keep credentials confidential and maintain accurate account information.
- Uploading public content may require prior approval through the application process.
- Arc en Ciel may suspend accounts, posting rights, API keys, or access where required by these terms, safety, law, or platform integrity.
User-Generated Content
You retain ownership of content you upload. To operate the platform, you grant Arc en Ciel a limited, worldwide, non-exclusive, royalty-free licence to host, cache, store, reproduce, technically adapt, transmit, display, index, moderate, and make your content available through the platform features you choose to use.
You warrant that you have the rights needed to upload and share your content, that it does not infringe third-party rights, and that any adult or sensitive material complies with applicable law and platform rating rules.
AI and Synthetic Content
- You remain responsible for prompts, uploads, model files, LoRAs, captions, tags, training notes, and other materials you submit or publish.
- You must not create, host, advertise, or route requests for CSAM, non-consensual intimate imagery, unlawful extremist material, malware, fraud, rights-infringing material, or other illegal content.
- We may label, age-gate, restrict, remove, or deprioritise synthetic content where needed for transparency, safety, law, or policy enforcement.
Supporter Program, Billing, and Payments
- Optional recurring supporter memberships and optional one-time donations are processed by Stripe.
- Supporter payments are not investments, securities, profit-sharing products, or guaranteed-return products.
- We do not accept cryptocurrency payments or direct bank transfers for supporter checkout.
- Recurring memberships renew until cancelled through the available billing flow.
- Completed one-time donations and already-started paid membership periods are generally non-refundable unless mandatory law requires otherwise or we expressly agree otherwise.
- Supporter-only digital perks may begin immediately after successful payment and checkout can require pricing, renewal, policy, immediate-access, and withdrawal confirmations.
Moderation, Notice, and Takedown
We may remove content, restrict visibility, correct rating labels, age-gate material, disable downloads, preserve evidence, warn users, apply strikes, restrict features, suspend accounts, terminate accounts, or escalate urgent cases.
Illegal-content notices can be submitted through /report-illegal-content or by contacting [email protected]. Affected users may request review where a moderation outcome provides a review path or where they can identify the account, content, and decision.
Governing Law and Liability
These terms are governed by German law. Mandatory consumer-protection rules of your habitual residence remain unaffected where they grant greater protection.
Nothing excludes liability for intent, gross negligence, injury to life, body, or health, fraud, product liability, or other liability that cannot be limited under mandatory law. In cases of slight negligence, liability is limited as described in the full terms shown to users.
